Understanding Family Law in the UK: Divorce, Separation, and More
What is Family Law?
Family law is a branch of the legal system that deals with family matters and domestic relations. In the UK, family lawyers handle a wide range of cases including divorce, separation, child arrangements, domestic violence, and division of matrimonial property. A family court lawyer provides legal advice and representation to help clients navigate the complex family justice system.
Divorce and Separation
To file for divorce in the UK, you must have been married for at least one year and your marriage must have permanently broken down. There are five grounds for divorce:
- Adultery
- Unreasonable behaviour
- Desertion
- 2 years separation with consent
- 5 years separation without consent
The divorce process begins by filing a divorce petition with the court. The respondent then has 8 days to file an acknowledgement of service indicating whether they intend to defend the divorce. If undefended, the petitioner can apply for Decree Nisi 20 weeks after the petition. 6 weeks and 1 day after Decree Nisi, the petitioner can apply for Decree Absolute to finalize the divorce.
For more information, see the Divorce, Dissolution and Separation Act 2020, which states:
“The Divorce, Dissolution and Separation Act 2020 will revise the legal process in England and Wales for married couples to obtain divorces and for civil partners to dissolve their civil partnership. Under the Act, the ability of one spouse to contest a divorce will be removed.”
Child Arrangements
When parents divorce or separate, child custody lawyers help determine arrangements for children, including where they will live and how much time they will spend with each parent. The court’s paramount concern is the welfare of the child. If parents cannot agree, the judge will make a child arrangements order setting out:
- where the children will live
- when the children will spend time with each parent
- who has parental responsibility
Domestic Violence
Domestic violence is a serious issue impacting many families. Victims of domestic abuse can seek legal protection through non-molestation orders and occupation orders. A non-molestation order prohibits an abuser from using or threatening violence against the victim. An occupation order regulates who can live in the family home. Domestic violence lawyers provide sensitive legal advice and strong advocacy in court to secure protection for victims.
Matrimonial Property
When a marriage ends, the matrimonial assets must be divided between the spouses. This includes the family home, savings, investments, and pensions. The starting point is a 50-50 split, but the court can depart from this if appropriate in the circumstances. Factors the court considers include the needs of any children, the length of the marriage, and the parties’ financial resources and needs. The law aims for a fair financial settlement.
